Terms of Service

The agreement for using Trakily: accounts, trials, plans and limits, payments through our Merchant of Record, acceptable use, the API, liability and termination.

Last updated Effective 8 October 2026

The short version

  • Trakily is a business tool. By creating an account you agree to these terms on behalf of yourself or the company you represent.
  • Every account starts with a 14-day free trial, no card needed. After that you pick a paid plan; without one, dashboards lock and collection pauses 15 days later.
  • Payments, invoices and sales tax are handled by Dodo Payments, our Merchant of Record.
  • You are responsible for using Trakily lawfully on your websites, including telling visitors about it and asking for consent where your law requires.
  • Your data stays yours. We process visitor data only to run analytics for you, under our DPA.
  • You can cancel at any time. We can suspend accounts that break the acceptable use rules or put the service at risk.
  • These Terms are governed by Indian law, with the courts at Jaipur, Rajasthan, without taking away consumer rights you have where you live.

This summary helps you find your way around. The full text below is what applies.

01The agreement

These Terms of Service (the “Terms”) are an agreement between you and Trakily, based at A-266, Triveni Nagar, Jaipur, Rajasthan 302018, India (“Trakily”, “we”, “us”). They apply to the Trakily website, dashboard, tracking scripts, API, widgets and every related service (together, the “Service”).

By creating an account or using the Service you accept these Terms. If you accept them for a company or other organisation, you confirm that you are authorised to bind it, and “you” means that organisation.

These documents form part of the agreement: our Privacy Policy, the Data Processing Agreement, the Refund Policy and the Cookie Policy. If they conflict, the DPA wins on data protection matters and these Terms win on everything else.

02Definitions

  • Account: your Trakily login and everything attached to it.
  • Website: a site or app you add to Trakily and install the tracking script or server snippet on.
  • Visitor: a person or bot that visits one of your Websites.
  • Customer Data: all data collected through your Websites or imported from services you connect, including Visitor data and revenue data.
  • Event: a single tracked occurrence, such as a page view, page leave, custom event, goal, outbound click, identify call or payment. Events count toward your plan's monthly allowance.
  • Plan: the subscription tier you choose (Starter, Growth or Scale), with the limits shown on our pricing page.

03Eligibility and your account

  • You must be at least 18 and able to enter a binding contract. Trakily is intended for business and professional use.
  • Give us accurate details and keep your email address current, because we send important account and billing notices there.
  • Keep your password and API keys safe. You are responsible for activity under your Account, including by team members you invite.
  • Tell us promptly at [email protected] if you suspect someone has accessed your Account without permission.
  • One person or organisation may hold several Accounts only for genuinely separate purposes, not to get around plan limits or trials.

Team members you invite get access to the Websites you choose, with the role you give them (owner, member or viewer). Owners can manage billing-relevant settings and remove other members.

04The Service

Trakily gives you, depending on your Plan:

  • a lightweight tracking script (with a cookie-based and a cookieless version), an optional managed proxy on your own subdomain, and a server-side snippet for crawler and AI bot traffic;
  • dashboards for traffic, channels, pages, locations, devices, goals, funnels and visitor journeys;
  • revenue attribution by connecting your payment provider, including MRR and subscription metrics;
  • integrations with Google Search Console, Meta Ads and others, and imports from Google Analytics 4 and Plausible, processed in chunks so large histories can be brought in reliably;
  • discovery of public posts that link to your Website, and a Launches view that groups launches, mentions and campaigns with the visitors, sign-ups and revenue that followed;
  • email reports and alerts, public dashboard links and embeddable widgets;
  • a REST API with per-Website API keys on plans that include API access.

We keep improving Trakily, so features change over time. We will not remove a core feature you pay for during a paid period without telling you in advance. Features marked as beta or preview are offered as they are and may change or end.

Numbers in Trakily are estimates. Ad blockers, privacy settings, cookie choices, cookieless mode and network conditions all mean that some visits are never recorded, and attribution is a model, not a certainty. Please don't rely on Trakily as your system of record for accounting, tax or legal purposes. See Data accuracy and your responsibility.

05Free trial

  • New Accounts get a 14-day free trial with Growth plan limits, plus API access. No payment card is needed to start.
  • You can subscribe during the trial and keep your remaining trial days: your first charge is taken when the trial ends.
  • We remind you before the trial ends. If you have not picked a plan when it ends, dashboards are locked behind an upgrade prompt straight away, and your Websites keep collecting for 15 more days before collection pauses (see When collection pauses). Without a subscription, nothing is ever charged.
  • Your data is kept after the trial ends. It is never deleted because a trial ended; picking a plan unlocks it and you carry on where you left off.
  • One trial per person or organisation. We may end a trial early if it is being abused.

06Plans and usage limits

Each Plan includes a monthly Event allowance counted across all Websites you own, a number of Websites, how far back you can view your data (history) and a set of features, as shown on our pricing page when you subscribe. Usage is counted in monthly windows, including on yearly plans.

If you go over your Event allowance

  • At 80% of your allowance we send a warning by email and show a banner.
  • From 100% we keep collecting and tell you that you are over the limit.
  • From 120% we keep collecting for 15 more days, counted from the first time you reach 120% in that monthly window. Then collection pauses until the next monthly window starts or you upgrade. A new window starts the count again.

We tell you in the dashboard and by email at each of these steps, including the date collection will pause.

Websites

You cannot add more Websites than your Plan allows. If you downgrade, existing Websites keep collecting and we ask you to upgrade or remove some.

History and data storage

Each Plan states how much history you can view (1, 3 or 5 years). We store Event data for up to 10 years whatever your Plan, and delete older data automatically. Moving to a Plan with less history hides older data but does not delete it; upgrading shows it again straight away.

After a downgrade, existing team members, Websites and data are kept; only adding more than the new Plan allows is blocked, and features the new Plan does not include are hidden until you upgrade.

Fair use

Plans are priced for normal website traffic. If an Account generates load far beyond its Plan, for example through automated or fake traffic, we may contact you about moving to a suitable Plan or take the steps in Suspension and termination.

07When collection pauses

"Collection" means storing new data for a Website. Pausing it never deletes anything you already have. Collection pauses in these cases:

  • Trial ended or plan ended. If your free trial ends without a plan, or a cancelled subscription reaches the end of its paid period, dashboards lock straight away and your Websites keep collecting for 15 days. Then collection pauses until you pick a plan.
  • Failed payment. Your Websites keep collecting for 15 days from the first failed renewal payment. Then collection pauses until the payment succeeds.
  • Over your Event allowance. Your Websites keep collecting for 15 days from the first time you reach 120% of the allowance in a monthly window. Then collection pauses until the next window or an upgrade.
  • Account deletion. Websites that only you own stop collecting immediately, for the 30 days your Account can still be restored.
  • Paused by you. An owner can pause tracking for a Website in its settings at any time, and resume it whenever they like. We may also pause a Website under Suspension and termination.

Before a pause, we show the date in the dashboard and send it by email. If you pick a plan, fix the payment or upgrade before that date, there is no gap. We may lengthen these grace periods for everyone; we will not shorten them without updating these Terms.

What stops and what keeps running

While collection is paused for a Website, we store nothing new for it: page views and events from the script, events sent through the API, bot hits, revenue from connected payment providers (their webhooks are acknowledged but not stored), Search Console and Meta Ads syncs and mention discovery. GA4 and Plausible history imports keep running unless the Website is suspended or its Account is locked and past the grace period. Your existing data stays stored, exports keep working, and dashboards stay open unless the Account is locked.

When collection resumes

Collection resumes as soon as the reason goes away: you pick a plan, the payment succeeds, a new monthly window starts or you upgrade, or the Website is resumed. We then fetch what we missed from the providers' own history: revenue from connected payment providers, Search Console data (up to the 16 months Google keeps) and Meta Ads spend (up to the 37 months Meta keeps). Page views and events sent to Trakily while collection was paused were never stored and cannot be recovered.

08Payments, renewals and taxes

Trakily subscriptions are sold through Dodo Payments, which acts as our Merchant of Record. That means Dodo Payments is the seller of record for your purchase: it processes your payment, issues your invoices or receipts, and calculates, collects and remits sales tax, VAT or GST where it applies. When you pay, you also accept Dodo Payments' buyer terms, which are shown at checkout. Your card or bank details go to Dodo Payments, never to us.

  • Prices. Plans are billed monthly or yearly, in advance, at the price shown at checkout. Prices exclude taxes unless checkout says otherwise.
  • Renewals. Subscriptions renew automatically at the end of each billing period until you cancel.
  • Plan changes. Upgrades and downgrades take effect immediately, and the difference is prorated by our Merchant of Record as shown when you confirm the change.
  • Failed payments. If a renewal fails, you keep full access while the payment is retried and you update your payment method. Your Websites keep collecting for 15 days from the first failed payment; if it is still unpaid then, collection pauses until payment succeeds. Separately, if the subscription is on hold for 7 days, dashboards lock until payment succeeds.
  • Price changes. We will give you at least 30 days' notice of a price increase. It applies from your next renewal, and you can cancel before then.
  • Invoices and billing details are available in the billing portal, which you can open from your account settings.

09Cancellation and refunds

You can cancel at any time from the billing portal in your account settings. Your Plan stays active until the end of the period you have paid for, then the Account moves to the expired state described under Free trial.

Refunds are covered by our Refund Policy. Nothing in these Terms limits rights you have under consumer law that cannot be waived, including the Consumer Protection Act, 2019 in India and the mandatory consumer laws of the country where you live.

Deleting your Account cancels an active subscription automatically at the end of the paid period, so you are not charged again. If the cancellation cannot be completed, nothing is deleted and you can try again. Deleting an Account does not by itself give a refund for the rest of the paid period, beyond what the Refund Policy provides.

10Your data and our role

  • You own Customer Data. You give us a limited licence to host, process and display it only to provide, secure and support the Service for you.
  • For personal data in Customer Data you are the Data Fiduciary (controller) and Trakily is your Data Processor. Our Data Processing Agreement applies automatically and forms part of these Terms.
  • We do not sell Customer Data, use it for advertising or share it with other customers.
  • We may use aggregated, de-identified statistics about how the Service is used (for example total event volume) to run and improve Trakily, provided they cannot identify you, your Websites or any individual.
  • You can delete a Website, an import or your whole Account at any time. Deleting an Account deletes the Websites you solely own and all their data. Websites you share with another owner stay with them.

11Your responsibilities when you track visitors

You decide where Trakily runs and what it collects, so you are responsible for using it lawfully. In particular you agree to:

  • Tell visitors. Describe your use of Trakily in your own privacy notice, including the data collected and, if you use the cookie-based script, the cookies listed in our Cookie Policy.
  • Get consent where it is required. Some laws (such as the ePrivacy rules in the EU and UK) require consent before non-essential cookies are set or information is read from a device. If they apply to you, either load the Trakily script only after consent, for example through your consent banner, or use the cookieless script and check that it meets your requirements. You are responsible for that judgement.
  • Have a lawful basis for the analytics you run and for connecting your payment provider and other services.
  • Keep sensitive data out. Do not send special category data (such as health, religion, sexuality or political opinions), government identifiers, payment card numbers or passwords to Trakily in URLs, event names, properties or identify calls. Do not install Trakily on pages that reveal sensitive information about the visitor, such as patient portals or account pages that expose personal details in the URL.
  • Use identify() and email-based payment matching carefully. Send only the personal data you need, and only where you are allowed to.
  • Respect children's privacy. Do not use Trakily on services directed at children without meeting the laws that apply to them.
  • Handle visitor requests. Respond to requests from your Visitors about their data. We will help as described in the DPA.
  • Proxies. If you route the script or events through your own proxy, forward the visitor's IP address in the standard header so exclusions and rate limits work correctly.

12Acceptable use

You must not use the Service, or let anyone else use it, to:

  • break any law, or infringe anyone's privacy, intellectual property or other rights;
  • track Websites you do not own or are not authorised to measure;
  • collect data to identify, profile, stalk or discriminate against individuals, or combine Trakily data with other sources to re-identify Visitors without a lawful basis;
  • track websites that are unlawful, or that exist mainly for malware, phishing, fraud, spam, or the sexual exploitation of anyone;
  • send fake, automated or inflated traffic, or manipulate statistics, public dashboards or widgets to mislead others;
  • probe, scan or test the vulnerability of the Service, bypass rate limits, plan limits or security measures, or access data that is not yours (responsible disclosure to [email protected] is welcome);
  • overload the Service, interfere with other customers, or use it in a way that degrades it for others;
  • copy, scrape, reverse engineer or resell the Service, or use it to build a competing product, except where the law allows this despite these Terms;
  • upload malware or content you do not have the right to share;
  • use public dashboards, widgets or alert messages to publish personal data about Visitors.

If we believe these rules are being broken, we may remove content, disable features, revoke API keys or take the steps in Suspension and termination.

13API terms

On Plans that include API access, you can create API keys for each Website and read your data programmatically. When you use the API:

  • Treat API keys like passwords. Keys are scoped to a single Website; anyone with a key can read that Website's data. Revoke a key in the dashboard as soon as you suspect it has leaked.
  • Stay within the rate limits and quotas we publish in the API documentation. We may throttle or temporarily block traffic that exceeds them.
  • The API, its endpoints and response formats may change. We will version breaking changes and give reasonable notice before retiring a version, except where a change is needed for security or legal reasons.
  • Applications you build on the API must not misrepresent their relationship with Trakily, and you remain responsible for how they store and use the data they retrieve.
  • We may suspend API access that threatens the stability or security of the Service.

14Third-party services

Trakily connects to services run by others, such as payment providers, Google, Meta, Slack, Discord and social platforms. Your use of those services is governed by their terms, and they are responsible for them. We are not liable for their availability, changes to their APIs or data they supply. If a provider changes or withdraws access, the related Trakily feature may stop working.

When you connect a service, you authorise us to access it on your behalf for the purpose described in the dashboard, until you disconnect it.

15Public dashboards and widgets

You can publish a read-only dashboard link or embed widgets showing live statistics. Anyone with the link, or anyone visiting a page where a widget is embedded, can see what you publish. Make sure you are comfortable sharing it, and turn the link or widgets off at any time from your site settings. You are responsible for what you choose to make public.

16Our intellectual property and feedback

The Service, including its software, design, documentation and the Trakily name and logo, belongs to us or our licensors. These Terms give you a limited, non-exclusive, non-transferable right to use the Service during your subscription. Nothing else is transferred.

If you send us ideas or feedback, we may use them without any obligation to you. We will not identify you publicly as their source without your permission.

17Availability and support

We work hard to keep Trakily fast and available, but we do not promise uninterrupted service. Planned maintenance, problems with our providers and events outside our control can cause downtime. Support is provided by email; Scale plans get priority support. We do not offer a contractual uptime commitment unless we agree one with you in writing.

18Suspension and termination

By you

You can stop using Trakily at any time by cancelling your subscription and, if you wish, deleting your Account in account settings. A deleted Account can be restored for 30 days by signing in again; we remind you 3 days before it is deleted for good.

By us

We may suspend or end your access, in whole or in part, if:

  • you seriously or repeatedly break these Terms, including the acceptable use rules;
  • your use creates a security, legal or operational risk to us, other customers or Visitors;
  • payment remains unpaid after the grace period described above;
  • we are required to by law or by a competent authority.

Where reasonable, we will warn you first and give you a chance to fix the problem. We may also stop offering the Service altogether with at least 60 days' notice, in which case we will refund any prepaid fees for the period after it ends.

What happens to your data

After your subscription ends, dashboards lock, collection pauses 15 days later, and your data is kept, locked, until you pick a plan again or delete your Account (within the 10-year storage limit). After you delete your Account, it can be restored for 30 days; then it is deleted from our live systems, and from backups as they cycle out, except the minimal billing record and deletion log described in the Privacy Policy. Export your data before deleting if you want a copy.

Sections that by their nature should continue (such as payment owed, liability limits, indemnities and governing law) survive termination.

19Disclaimers

Apart from what we expressly promise in these Terms, the Service is provided “as is” and “as available”. To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that statistics, attribution or revenue figures will be complete or exact.

Data accuracy and your responsibility

  • Trakily is an independent third-party service. It combines data from the tracking on your Websites and from the providers you connect (payment providers such as Dodo Payments, Stripe, Polar, Lemon Squeezy, Paddle and Razorpay, and Google Analytics 4, Google Search Console and Meta Ads) on a best-effort basis.
  • Figures are estimates. Analytics, attribution and revenue figures can be incomplete or wrong. Causes include ad blockers, browser privacy features, consent choices, network failures, delays or errors in providers' APIs, currency conversion, refunds and disputes, and bugs.
  • Not a system of record. Trakily is not a system of record for financial, tax or accounting purposes. Your payment provider and your own records remain the source of truth.
  • Check before you rely on it. Check figures against those sources before relying on them for business, advertising, financial or tax decisions. You are solely responsible for the decisions you make using the Service.
  • Keep your own records. We are not responsible for loss, gaps or corruption of collected data, for example during an outage. Keep your own records and use the export features if you need a copy of your data.

20Limitation of liability

To the extent the law allows, and including any loss arising from the matters described in Data accuracy and your responsibility:

  • neither party is liable for indirect, incidental, special or consequential losses, or for lost profits, revenue, goodwill or data, even if warned that they were possible;
  • each party's total liability arising out of or relating to these Terms is limited to the amount you paid for the Service in the 3 months before the event giving rise to the claim.

These limits do not apply to your payment obligations, to your obligations under Indemnity, or to liability that cannot be limited by law, such as for fraud, or death or personal injury caused by negligence.

Nothing in these Terms limits statutory rights you have as a consumer that cannot be excluded or limited, including under India's Consumer Protection Act, 2019 and the consumer laws of the European Union and the United Kingdom.

21Indemnity

You will defend and indemnify Trakily against claims by third parties, including Visitors and regulators, that arise from your Websites, your Customer Data, your failure to meet your responsibilities in Your responsibilities when you track visitors, or your breach of the acceptable use rules, and you will pay the resulting damages, fines and reasonable costs. We will tell you promptly about any such claim and let you control its defence.

22Events beyond our control

Neither party is responsible for delays or failures caused by events outside its reasonable control, such as natural disasters, war, large-scale internet or power outages, failures of upstream providers, or actions of governments. This does not excuse payment obligations.

23Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Subject to the paragraph below, the courts at Jaipur, Rajasthan, India have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except that either party may seek urgent injunctive relief in any competent court.

Before starting formal proceedings, please contact us at [email protected] or our Grievance Officer so we can try to resolve the issue informally. Consumers in India keep their rights under the Consumer Protection Act, 2019, including to approach the Consumer Disputes Redressal Commissions.

If you are a consumer living in the European Union, the United Kingdom or another country whose law does not allow it to be excluded, you keep the protection of the mandatory consumer laws of the country where you live, and you may bring proceedings in its courts.

24Changes to these Terms

We may update these Terms as the Service and the law evolve. For material changes we will give you at least 30 days' notice by email or in the dashboard. If you do not agree, you can cancel before the change takes effect; continuing to use the Service afterwards means you accept the new Terms. The date at the top of this page shows the current version.

25General

  • Entire agreement. These Terms and the documents they refer to are the whole agreement between us about the Service.
  • Assignment. You may not transfer your Account or these Terms without our consent. We may transfer them to a successor in a merger, acquisition or sale of assets.
  • Severability. If a court finds part of these Terms unenforceable, the rest stays in force.
  • No waiver. Not enforcing a right straight away does not mean we give it up.
  • Notices. We send notices to the email address on your Account. You send notices to [email protected].
  • Independent parties. Nothing in these Terms creates a partnership, employment or agency relationship.
  • Export and sanctions. You confirm you are not subject to sanctions that would prohibit you from using the Service.
